6.1 Confidential Information. Each party acknowledges and agrees that all
business and technical information provided to it by the other party
pursuant to this Agreement constitutes confidential and/or proprietary
information of the other party (“Confidential Information”).
Confidential Information shall includes all oral, written or recorded
confidential and/or proprietary information about or related to the
disclosing party or its business, including without limitation the
terms and conditions of this Agreement. Notwithstanding the foregoing,
Confidential Information does not include information that (i) is or
becomes publicly available without breach of this Agreement; (ii) can
be shown by documentation to have been known to the receiving party
prior to its receipt from the disclosing party; (iii) is rightfully
received from a third party who did not acquire or disclose such
information by a wrongful or tortious act; (iv) can be shown by
documentation to have been developed by the receiving party without
reference to any Confidential Information; or (v) that the receiving
party becomes legally obligated to disclose to a governmental entity
with jurisdiction over it. In addition, each party is entitled to
disclose the terms and conditions of this Agreement (vi) as required
by law, including applicable securities law, and (vii) to banks,
proposed investors and financing sources, where disclosure is related
to securing additional financing for that party.

(i) Obscene material, including without limitation any material depicting rape, bestiality, or torture.

(ii) Any material, which is displayed or transmitted in a way as to constitute harmful matter or indecent communications to minors;

(iii) Any material in which persons under the age of 18 years of age are portrayed in actual, simulated or suggestive sexual situations;

(iv) Any material not fully in compliance with 18 U.S.C. Sec. 2257 et seq.;

(v) Any material which constitutes child pornography or matter which involves depictions of nudity or sexuality by an age inappropriate-looking performer (i.e. someone who looks younger than 18 years of age), or by a performer who is portrayed or made to appear to be a person under the age of 18 years of age by virtue of the make-up, script, demeanor, costuming, or setting. Prohibited material mentioned herein includes the use of the term ‘lolita’ for any purpose in any fashion including within HTML meta-based tags.

(vi) Any material, which is abusive, threatening, hateful, defamatory, libelous, slanderous, scandalous or injurious to the reputation of any person or entity;

(vii) Any material which constitutes an infringement, theft, misappropriation or violation of any person’s intellectual property rights such as trademark rights, copyrights, rights of publicity, patent rights, personal property rights, privacy rights or other rights; or

(viii) Any program, data stream, file or other material which contains worms, viruses, “Trojan horses” or any other destructive feature, regardless of whether damage is intended or unintended, which may cause damage to any computer equipment, loss or corruption of data or programs or inconvenience to any person.

It is understood as follows:

a. that a Thirty Day Notice of Intent to Vacate is required by Section 1946 of California Civil Code for month-to-monthtenancies and by the Lease Agreement for fixed-term tenancies;

b. for Residents on a fixed-term lease, a Thirty Day Notice of Intent to Vacate does not relinquish Resident from any obligationof the lease, including payment to the end of the lease term;

c. Resident’s possession of the apartment remains in effect until all belongings are removed and all keys returned; and

d. except as provided by law, rent is due and payable up to and including the final date of possession, or thirty (30) days afterservice of this notice to Manager, whichever is later.

e. Resident cannot use the security deposit as last month’s rent. NOTICE OF RIGHT TO INITIAL INSPECTION:I understand that I have the right to request an initial inspection of my unit and to be present during that inspection, which shall occurno earlier than two weeks before the termination of the tenancy and during normal business hours. I also understand that at this initialinspection, the Manager will provide an itemized statement specifying repairs or cleaning that are proposed to be the basis for thedeductions from the security deposit. I understand, however, that this may not be the final accounting of deductions from my securitydeposit. I understand that no later than three weeks (21 days) after Manager has regained possession of the premises, Manager shallprovide me with an itemized statement, indicating the basis for, and the amount of, any security deposit received and the disposition ofthe security and shall return any remaining portion of such security deposit to me.
